01 | Objectives of Personal Data Processing

The Royal Automobile Club of Belgium (RACB) and all the companies in its group are deeply committed to respecting your personal data and protecting your privacy, and are aware of the importance you attach to it. The RACB aims, as far as possible, to inform you, respect your rights, and allow you to control what happens to your personal data, as provided by the European Regulation 2016/679 of 27/04/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, known as the GDPR, General Data Protection Regulation (hereinafter the "Regulation"). Whether you are a member, licensee, client, contractor, and/or visitor to our websites and/or user of our applications, this privacy policy (hereinafter, the "Privacy Policy" or the "Policy") is intended to clearly inform you about how your personal data is collected and processed by the RACB and about the means you have to control this use. You give your consent to this Policy, particularly by expressly checking a box provided for this purpose by continuing to visit our site or using certain of our services. If you are not required to provide your data to the RACB or accept its processing, some communications are nevertheless necessary, notably to allow the execution of a contract and/or compliance with the legislation in force. Modifications may be made to the Policy at any time. It also applies to the collection, management, and use of your data by other entities related to the RACB, without prejudice to additional conditions applicable to specific services or applications. 02 | Scope of Application

This Privacy Policy sets out the principles and guidelines for the protection of your personal data, collected during your visit to this site and/or in the context of our sports, contractual, or commercial relationships. The notion of personal data (hereinafter "Personal Data" or "Data") refers to any information relating to an identified or identifiable individual. A person is "identifiable" as soon as they can be identified, directly or indirectly, in particular by reference to one or more elements specific to them. This Privacy Policy only applies within the context of our relationships with natural persons. In the case of legal entities, this Policy only applies to personal data relating to the natural persons who represent or act as representatives of the legal entity (such as agents, employees, or any other contact person). Conversely, "non-personal data" refers to information that does not allow the identification of a natural person.

For certain tasks, the RACB uses other companies (for example, technical maintenance of our websites, etc.). These companies will only have access to your personal data to the extent necessary for their intervention. The number of employees or collaborators having access to your personal information is restricted, and this access only takes place to the extent necessary for the performance of their duties.

The RACB uses cookies to collect information to improve navigation on the site or the use of mobile applications and to provide commercial or marketing information to its owner. 10 | Your Rights Regarding the Personal Data We Collect

Your Personal Data is always processed in accordance with the legitimate purposes outlined above. It is collected and processed in an appropriate, relevant, and non-excessive manner and is not retained longer than necessary to achieve the intended purposes.

 

10.1. Right to Object to Use for Marketing Purposes

You can object, at any time and without reason, in whole or in part, to the RACB's use of your data for marketing purposes (direct marketing), including related profiling. You can notify us of this:

10.2. Right to Access Your Data

If you can prove your identity, you have the right to obtain information about the processing of your Data. This includes the right to know the purposes of the processing, the categories of data concerned, the categories of recipients to whom the data is transmitted, the criteria used to determine the data retention period, and the rights you can exercise over your data.

 

10.3. Right to Rectification

Inaccurate or incomplete Personal Data can be corrected, either via your user account by making the necessary changes yourself, or by directly contacting the Data Protection Officer (see contact details above).

 

10.4. Right to Erasure (or "Right to be Forgotten")

You have the right to obtain the erasure of your Personal Data in the following cases: (a) your Personal Data is no longer necessary for the purposes, (b) you withdraw your consent to the processing and there is no other legal basis for processing, (c) you have validly exercised your right to object, (d) your data has been processed unlawfully, (e) your data must be erased to comply with a legal obligation. The RACB determines on its own whether the above criteria apply.

 

10.5. Right to Restriction of Processing

In certain cases, you have the right to request the restriction of the processing of your Personal Data, particularly in cases of dispute over the accuracy of the data, if your data has been processed unlawfully, if the data is needed in the context of legal proceedings, or for the time necessary for the RACB to verify whether you can validly exercise your right to erasure.

 

10.6. Right to Object

You have the right to object at any time to the processing of your Personal Data. The RACB will then cease processing your Personal Data, unless it demonstrates compelling legitimate grounds for the processing that override your right to object.

 

10.7. Right to Data Portability

You have the right to obtain all the Personal Data you have provided to us in a structured, commonly used, and machine-readable format. Upon your request, this data can be transferred to another service provider, unless this is technically impossible.

 

10.8. Right to Withdraw Consent

You can withdraw your consent to the processing of your Personal Data at any time. The withdrawal of your consent does not affect the validity of processing operations carried out prior to the withdrawal.

 

10.9. How to Exercise Your Rights

To exercise your rights, you must send a request to the Data Protection Officer, i.e., the ASBL RACB, by postal mail [Boulevard de la Woluwe, 46, 1040 Brussels] and/or by email [dpo@racb.com], accompanied, if applicable, by proof of your identity. A response will be provided as soon as possible, and at the latest one (1) month after receipt of the request.

 

10.10. Possibility to Lodge a Complaint

If you are not satisfied with the processing of your Personal Data by the RACB, you have the right to lodge a complaint with the Data Protection Authority as of May 25, 2018 (https://www.privacycommission.be).
